MAXIMUM CHARGES APPLICABLE FOR MOORING AND UNMOORING SERVICES
Maximum charges and rules of application
- The Port Authority shall monitor and ensure transparency in the setting of charges and services invoiced.
- In the event of any discrepancy regarding the application of the maximum charges between the licensee and the master, owner or agent of the vessel, the Port Authority reserves the right to act as mediator for the purpose of determining the applicable charge.
- When maximum charges have been declared applicable, the amounts charged by each service provider shall in all cases be lower than or equal to the maximum charges established in this section.
- Charges are established by zone and type of traffic.
- Surcharges may be applied depending on incidents attributable to users in the following situations:

- Cancellation attributable to the vessel prior to the mooring services becoming available. If the vessel’s representative or captain changes the time requested and set for the start of operations, the following surcharges shall apply:
- Cancellation made within one hour prior to the time initially requested for the start of the operation: 25% of the corresponding fee.
- Modification or cancellation made more than one hour prior to the time initially requested for the start of the operation: no surcharge.
- Cancellations attributable to the vessel after the mooring service has been made available shall give rise to the following surcharges:
- Cancellations made up to 30 minutes after the service has been made available: 50% of the corresponding fee.
- Cancellations made between 31 and 60 minutes after the service has been made available: 75% of the corresponding fee.
- Cancellation made 61 minutes or more after the service has been made available: 100% of the corresponding fee.
- Delay in service provision caused by the vessel (from the moment the service is made available to the vessel’s captain):
- Delay of up to 30 minutes: no surcharge.
- Delay between 31 and 60 minutes: 50% surcharge on the original fee.
- Delay between 61 and 120 minutes: 100% surcharge on the original fee.
- Subsequent hours (per hour): 50% additional surcharge on the applicable fee.
- Cancellation attributable to the vessel prior to the mooring services becoming available. If the vessel’s representative or captain changes the time requested and set for the start of operations, the following surcharges shall apply:

- Reductions shall apply in the event of incidents attributable to service providers, including delays by the provider in initiating the service.

- First hour of delay: 10% reduction
- Second hour, or fraction thereof, of delay: 20% reduction
- From the second hour onwards: 20% reduction for each hour, or fraction thereof, up to a maximum of 100%.

- Updates due to cost variations that are applicable in accordance with the provisions of Section d. of these specifications shall be applied to all charges in this section.
- The charges to be applied shall be those offered by the successful bidder in each case, which in all cases shall be equal to or lower than the maximum charges established in these specifications.
- Application of charges:

- For mooring and unmooring services at buoys or shipyards, the charge corresponding to “Outer Port” shall apply.
- For cases not covered above, the Port Authority shall be consulted and shall resolve the matter.

- Maximum charges for special services:

- These shall apply in the case of services as defined in the Glossary in Appendix I of this document. For these purposes, the usual duration shall be considered to be 120 minutes. These charges shall be subject to a surcharge of 50% per hour, or fraction thereof, on the applicable charge.
- For the provision of additional mooring lines for vessels docked in port, 50% of the fee applicable to said vessel shall be charged for manoeuvres lasting less than 1 hour, and 100% of the fee applicable for manoeuvres lasting between 1 and 2 hours. From the second hour onwards, the charge described in the previous paragraph shall apply.

- The following reduction coefficients shall be applied by vessel type to the amounts indicated in the following tables:
- Car carriers, ferries and cruise ships: 75% of the base rate.
- Trailer-carrier vessels carrying trailers as base cargo: 55% of the base rate.

In view of the maximum character of the charges, the service provider may establish tariff agreements with the shipping company or its agent for specific vessel types, trade routes or regular shipping services.
