Art. 194. The taxable event of this rate applies to the ships’ use in the waters inside the port’s service area and the permanent port buildings and facilities, which allow access by sea to the berth or anchorage areas.
- The substitute taxpayer is the shipping agent in general. At docks, jetties and port berthing facilities that are granted under concession, the licence holder or authorised person shall be liable for the payment of this rate.
The taxpayer is the owner, ship or boat owner or captain or master of the ship.
Art. 196. The accrual of the rate shall be paid when the vessel enters the waters of the port’s service area.

Art. 200.2 Berthing on weekends and public holidays. For the purposes of calculating the time spent on weekends or public holidays, and provided always that there have been no commercial operations, shall be: Between 12 p.m. Saturday or 6 p.m. the day before a public holiday until 8 a.m. Monday or the day following the public holiday, : MAXIMUM 5 HOURS
When the time spent during that period exceeds 5 hours, the commencement of the time spent for the calculation of the maximum limit of 15 hours every 24 hours shall be measured from 8 a.m. Monday or the day following the public holiday.
A berthing request for a public holiday must be made to the Bilbao Port Authority before the weekend..
- By number of stopovers. Depending on the number of stopovers at the same port and during a calendar year made by ships that provide a SPECIFIC KIND OF TRAFFIC and are operated by the same shipping company or by a group of various shipping companies with shared use agreements in relation to the ships, the rate charge shall be multiplied, on prior request by the taxpayer, by the following coefficients:

Short sea shipping (SSS) is deemed as that shipping service for the carriage of goods and/or passenger traffic made using ships whose sea route plies only in Europe between geographically located European ports or between those ports and ports situated in non-European countries having a coastline on the landlocked seas bordering Europe, including its islands or non-sovereign territories of Europe. This concept is also broadened to include sea shipping between the Member States of the European Union and Norway and Iceland and other Member States of the Baltic, Black and Mediterranean Seas.
Shipping service: Is that service which provides a specific kind of traffic in a port, where the ship or group of ships of the same shipping company or cruise ship company together with other specific ships, carrying the same type or nature of goods or a specific type of passage, transport parts or freight unit.
Regular shipping service: Shipping service that regularly and generally advertises its services and which regularly plies between origins, destinations and pre-established dates and with at least 24 stopovers per year.
Article 245 Section 6th
1 – To encourage better environmental practices, the Port Authority will apply the following discounts
a) When the vessels certify compliance with certain conditions with respect to the environmental friendliness, and furthermore, the shipping company or, where appropriate, to which the vessel is the property of the ship owner, has a signed agreement with the Port Authority in terms of better environmental practices related to the operations and the stay of vessels in the port, to the vessel rate will apply a 5% discount.
2 – To increase quality in the rendering of services
a) When the shipping company has in force a services certificate whose scope includes all portbased ship operations, based on quality service benchmarks approved by State Ports or, where appropriate, in the specific reference documents approved in its implementation by the Port Authority, will apply a 5% discount to the vessel rate
3 – To encourage securing customers, customer loyalty and growth in traffic and shipping services that contribute to economic and social development of the economic influence area of the ports or that of Spain as a whole, discounts may be applied therein, but not greater than 40 % of the vessel rates fee.
