- Tariff structure
- The charges applicable to port towage services shall, as a minimum, include the following operations, regardless of the number of tugs requested and/or used, and no other concepts may be invoiced without the prior approval of the Port Authority:
- Incoming towage: service provided to a vessel or floating craft for the purpose of assisting it in its movements and manoeuvres in the waters of the port service area until it docks at the quay or jetty.
- Outbound towage: service provided to a vessel or floating craft to assist it in its movements and manoeuvres from its position at the dock or jetty berth until, once the vessel has entered the navigation channel, the pilot terminates the service.
- Internal movement: service provided to a vessel or floating craft to assist it in movements and manoeuvres involved in a change of berth.
- Standby service: service whereby a tugboat remains at the disposal (on call) of the requesting vessel, ready to intervene when instructed to do so by the captain or pilot, as appropriate. The tugboat may be positioned at its usual berth or at the point indicated by the vessel for the duration of the service, ready to intervene immediately, without being able to perform any other activity.
- Special service: service provided to a vessel or floating craft when a tugboat is made available for work that does not correspond to any of the manoeuvres a, b and c described above (e.g. availability as per point d above, pile driving works to reinforce moorings, etc.).
- Supply of lines: provision of towlines by the tugboat.
- For the purposes of the provision and tariff setting of port towage services, the following territorial areas are defined:
- OUTER AREA: one single section, comprising the jetties and berths at Punta Lucero, the refineries, BBG regasification plant, Punta Ceballos and Punta Sollana.
- INNER AREA: the remaining sections of the Port, i.e. the expansion docks, the Santurce docks, Deusto Canal, Zorroza and the other docks along the river.
- Requests for service provision shall be answered within one hour of the request being made, counting the time from the moment the request is made until the tugboat(s) is/are alongside the vessel, ready to begin the manoeuvre. When delays in service provision occur for reasons attributable to the contracting company, that company shall apply the following percentage reductions to the corresponding fee:
- Delay of 30 minutes or less: 0%
- Between 31 minutes and 1 hour: 10%
- The second hour (or fraction thereof): 20%
- From 2 hours onwards: 20% for each hour or fraction thereof
- No additional or differentiated costs shall be admissible based on the day or time at which the service is provided, in accordance with the provisions of Section h) of Article 113.4 of the Consolidated Text of the Law on State Ports and the Merchant Navy

- Maximum rates and rules of application
- In compliance with the provisions of Article 125.2.d of the Consolidated Text of the Law on State Ports and the Merchant Navy, when circumstances arise in which there is no effective competition, the Board of Directors of the Port Authority, following approval of the Specific Requirements and Conditions, shall approve application of the maximum charges.
- The Port Authority shall monitor and ensure transparency in the setting of charges and services invoiced.
- In the event of any discrepancy regarding the application of the maximum charges between the licensee and the master, owner or agent of the vessel, the Port Authority reserves the right to act as mediator for the purpose of determining the applicable charge.
- When maximum charges have been declared applicable, the amounts charged by each service provider shall in all cases be lower than or equal to the maximum charges established in this section.

6. Surcharges may be applied depending on incidents attributable to users in the following circumstances:

- Dead vessels and/or vessels not under command: services provided to any vessel whose propulsion or steering system is out of service shall incur a surcharge of 50% on the corresponding general rate (excluding standby hours).
- In the event of cancellations or delays attributable to the vessel, cancellations notified less than 45 minutes before the requested service time shall be charged at 50% of the corresponding tariff.
- Delays occurring after the requested time for the provision of the service, with the tug(s) alongside the vessel and ready to commence the maneuvre, and which are attributable to the vessel, shall give rise to the following surcharges on the applicable tariff:

d. Amendments and berthing changes. The following charges shall apply to both amendments and berthing or anchoring changes:
- Within the same dock as a normal manoeuvre: no surcharge applicable.
- Manoeuvres between different docks in the same section: 25% surcharge on the applicable fee for the section in which the manoeuvre is carried out.
- Manoeuvres between sections: 50% surcharge on the applicable fee. The OUTER AREA consists of one section. The different sections within the INNER AREA are the extension docks, the Santurce docks and the other docks along the river.
e. A coefficient of 1.5 shall be applied to the applicable tariff for vessels bound for the river docks carrying exclusively cargo classified as hazardous.
f. For the purposes of commencement or completion of the service, the limits of the Port service area shall be deemed to begin at the outermost line connecting the end of the Punta Lucero breakwater with the Punta Galea caisson.
Vessels which, due to manoeuvring requirements, are required to take or release the tow outside the limits defined in the preceding paragraph shall be charged, as an out-of-limits operations tariff, an amount of 503.82 euros per tug. This charge shall apply when the tug’s movement in relation to the above-mentioned line is approximately one quarter (1/4) of a mile, and is carried out as required for the manoeuvre and the vessel’s assist.
g. Maximum hourly charges for special services, escort, pile driving manoeuvres and stand-by services other than for inbound, outbound or internal movement towing, shall be as follows:
- 642.86 euro/hour/tugboat < 2,000 H.P.
- 850.74 euro/hour/tugboat > 2,000 H.P.
Charges shall be invoiced for ½ hour periods, with a minimum charge of one (1) hour.
h. Supply of lines: in cases where the lines are provided by the tug, an additional charge of 158.32 euro/tug providing the lines shall be invoiced for each service performed.
i. Operations due to weather conditions: a 10% reduction on the applicable tariffs shall be applied to supplementary movements (entries, departures, etc.) in Section I resulting from exceptional meteorological conditions, provided that such operations are certified by the Harbour Master.
In the event of any discrepancy between the parties regarding the interpretation of the applicable charges or their amounts, the Port Authority shall be responsible for resolving such discrepancy.
