Section 4, Subsection 1.<\/h2>\n<ul>\n<li>\n<p><span class=\"fondoGrisClaro paddingLR5\">Art. 194.<\/span> <span style=\"text-decoration: underline;\">The taxable event<\/span>\u00a0of this rate applies to the ships\u2019 use in the waters inside the port\u2019s service area and the permanent port buildings and facilities, which allow access by sea to the berth or anchorage areas.<\/p>\n<\/li>\n<li>\n<p><span class=\"fondoGrisClaro paddingLR5\">Art. 195.<\/span><\/p>\n<ul>\n<li><span style=\"text-decoration: underline;\">The substitute taxpayer<\/span>\u00a0is the shipping agent in general. At docks, jetties and port berthing facilities that are granted under concession, the licence holder or authorised person shall be liable for the payment of this rate.<\/li>\n<li>\n<p>The\u00a0<span style=\"text-decoration: underline;\">taxpayer<\/span>\u00a0is the owner, ship or boat owner or captain or master of the ship.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p><span class=\"fondoGrisClaro paddingLR5\">Art. 196.<\/span> The\u00a0<span style=\"text-decoration: underline;\">accrual<\/span>\u00a0of the rate shall be paid when the vessel enters the waters of the port\u2019s service This concept is also broadened to include sea shipping between the Member States of the European Union and Norway and Iceland and other Member States of the Baltic, Black and Mediterranean Seas.<\/p>\n<\/li>\n<li>\n<p><strong>Shipping service:<\/strong>\u00a0Is that service which provides a specific kind of traffic in a port, where the ship or group of ships of the same shipping company or cruise ship company together with other specific ships, carrying the same type or nature of goods or a specific type of passage, transport parts or freight unit.<\/p>\n<\/li>\n<li>\n<p><strong>Regular shipping service:<\/strong>\u00a0Shipping service that regularly and generally advertises its services and which regularly plies between origins, destinations and pre-established dates and with at least 24 stopovers per year.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2>DISCOUNTS<\/h2>\n<h3><span class=\"fondoGrisClaro paddingLR5\">Article 245 Section 6th<\/span><\/h3>\n<ul>\n<li>\n<p><span class=\"fondoGrisClaro paddingLR5\">1 \u2013<\/span> To encourage better environmental practices, the Port Authority will apply the following discounts<\/p>\n<ul>\n<li>\n<p>a) When the vessels certify compliance with certain conditions with respect to the environmental friendliness, and furthermore, the shipping company or, where appropriate, to which the vessel is the property of the ship owner, has a signed agreement with the Port Authority in terms of better environmental practices related to the operations and the stay of vessels in the port, to the vessel rate will apply a 5% discount.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p><span class=\"fondoGrisClaro paddingLR5\">2 \u2013<\/span> To increase quality in the rendering of services<\/p>\n<ul>\n<li>\n<p>a) When the shipping company has in force a services certificate whose scope includes all portbased ship operations, based on quality service benchmarks approved by State Ports or, where appropriate, in the specific reference documents approved in its implementation by the Port Authority, will apply a 5% discount to the vessel rate<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p><span class=\"fondoGrisClaro paddingLR5\">3 \u2013<\/span> To encourage securing customers, customer loyalty and growth in traffic and shipping services that contribute to economic and social development of the economic influence area of the ports or that of Spain as a whole, discounts may be applied therein, but not greater than 40 % of the vessel rates fee.
